Terms of Use

These Terms are the agreement between you and Binaural Purrs for using the app. They are written to be readable; the headings are here to help you find things, not to hide anything.

Binaural Purrs (the “App”) is owned and operated by Binaural Purrs LLC, a Virginia limited liability company (“Binaural Purrs,” “we,” “us,” or “our”). These Terms of Use, together with our Privacy Policy, govern your access to and use of the App and any audio, characters, artwork, music, and other content we make available through it (together, the “Service”).

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1Who can use the App

You must be at least 18 years old to use the App. By using it, you confirm that you are 18 or older and that you can form a binding contract with us. The App is not directed to children, and we do not knowingly collect information from anyone under 18.

2Your license to use the App

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use one copy of the App on a device you own or control, for your own personal, non-commercial use.

This license does not transfer any ownership to you. You may not:

copy, sell, rent, lease, sublicense, distribute, or publicly perform the App or its audio, music, character art, or other content, except as the App's normal features allow;
reverse engineer, decompile, or attempt to extract the source code, audio files, or underlying assets of the App, except where that restriction is prohibited by law;
remove or alter any copyright, trademark, or other proprietary notices;
circumvent, disable, or interfere with any access controls, paywalls, or security features; or
use the App to build or train any competing product, dataset, or machine-learning model.

3Subscriptions, free access, and billing

The App offers a free tier and a paid subscription.

Free tier

Without subscribing, you can access a limited selection of the Service, including one track per cat. We may change what the free tier includes at any time.

Paid subscription

A Binaural Purrs subscription is $5.99 per month (or the current price shown to you in the App or app store at the time of purchase, which may vary by region and currency) and unlocks the full library of tracks and features.

Auto-renewal — please read. Your subscription automatically renews each month unless you cancel it. Payment is charged to your Apple App Store or Google Play account at confirmation of purchase. Your account is charged for renewal within 24 hours before the end of the current period, at the then-current price.

To avoid being charged for the next period, turn off auto-renewal at least 24 hours before the current period ends, in your device's subscription settings (Apple ID or Google Play account). Cancelling stops future renewals; it does not retroactively refund the current period.

All purchases are processed by Apple or Google, not by us, and are subject to that store's terms and payment rules. Refunds, where available, are handled by Apple or Google under their policies, except where a refund is required by applicable law. Except as required by law, payments are non-refundable and we do not provide refunds or credits for partial periods.

If we change subscription pricing, we will give notice as required, and the new price will apply to renewals after the change takes effect.

4What Binaural Purrs is — and isn't

Binaural Purrs is for relaxation, comfort, and enjoyment. It is not a medical product. The App, including its binaural beats, ambient music, and cat characters, is not intended to diagnose, treat, cure, or prevent any condition, and is not a substitute for professional medical, psychological, or mental-health advice, diagnosis, or treatment.

Any descriptions of brainwave states, focus, calm, sleep, or similar are offered as part of the App's character and vibe, not as clinical or scientific claims. Always seek the advice of a qualified professional with any questions about a medical or mental-health condition.

Safety. Do not use the App while driving or operating machinery, or in any situation where reduced alertness could be unsafe. If you have epilepsy, a seizure disorder, or any condition affected by audio or rhythmic stimulation, consult a doctor before use. Stop using the App and seek medical attention if you feel unwell while using it.

5Acceptable use

You agree to use the App only for lawful purposes and in line with these Terms. You agree not to misuse the Service, interfere with its normal operation, attempt to gain unauthorized access to it, or use it in any way that infringes the rights of others or violates any law.

6Intellectual property

The App and all of its content — including the names, designs, and personalities of Mio, Piper, Juniper, and Mona, all artwork and animation, all audio, music, and binaural beats, the “Binaural Purrs” name and logo, and the look and feel of the Service — are owned by Binaural Purrs LLC or our licensors and contributors, and are protected by copyright, trademark, and other laws. Nothing in these Terms gives you any right to use our names, logos, characters, or content except as the App's features allow.

7Feedback

If you send us ideas, suggestions, or feedback about the App, you agree we may use them freely, without any obligation or compensation to you, to operate and improve the Service.

8Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or available at any particular time, or that any defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

9Limitation of liability

To the fullest extent permitted by law, Binaural Purrs LLC and its members, contributors, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising out of or relating to your use of (or inability to use) the Service. To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the App in the twelve months before the event giving rise to the claim, or (b) US $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10Indemnification

You agree to indemnify and hold harmless Binaural Purrs LLC and its members, contributors, and licensors from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service or your violation of these Terms or of any law or third-party right.

11Termination

You may stop using the App at any time and delete it from your device. We may suspend or end your access to the Service at any time if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.

12App store terms

You obtained the App through the Apple App Store or Google Play, and your use is also subject to that store's terms and usage rules. The following applies in addition to those terms.

Apple App Store

If you downloaded the App from the Apple App Store, you acknowledge that:

these Terms are between you and Binaural Purrs LLC only, not Apple, and Apple is not responsible for the App or its content;
your license to use the App is limited to use on Apple-branded products you own or control, as permitted by the App Store Usage Rules;
Apple has no obligation to provide maintenance or support for the App — we are solely responsible for that;
if the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation for the App;
we, not Apple, are responsible for addressing any claims relating to the App, including product liability, legal or regulatory claims, and intellectual-property claims;
you represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties; and
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Google Play

If you downloaded the App from Google Play, your use is also subject to the Google Play Terms of Service, and references to refunds, maintenance, and support are handled in accordance with Google's policies.

13Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the App after changes take effect means you accept the updated Terms.

14Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Subject to the app store terms above, you agree that any dispute relating to these Terms or the Service will be brought in the state or federal courts located in Virginia, and you consent to their jurisdiction.
